Waste Collection Uxbridge Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Uxbridge provides waste collection and related services within Uxbridge and surrounding areas. By placing a booking or requesting services, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any service.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, organisation or other entity that requests or receives services from Waste Collection Uxbridge.

Services means waste collection, removal, transportation and associated services provided by Waste Collection Uxbridge, whether for domestic or commercial waste, as agreed in each booking.

Waste means any materials, items, rubbish, refuse, junk or similar matter presented for collection under a booking, excluding any prohibited or hazardous materials as set out in these Terms and Conditions or under applicable law.

Booking means a confirmed request for services made by the Customer and accepted by Waste Collection Uxbridge in accordance with these Terms and Conditions.

2. Scope of Services

Waste Collection Uxbridge provides waste collection and removal services for domestic and commercial customers in Uxbridge and nearby areas. The specific scope of services for each booking, including type of waste, volume or weight, location, collection date and time, and applicable charges, will be agreed with the Customer at the time of booking.

Services may include but are not limited to general waste collection, bulky item removal, garden waste collection, and other non-hazardous waste removal in line with relevant waste regulations. Any service description, quotation, or estimate given before the booking is made is an indication only and does not form a binding obligation until confirmed by Waste Collection Uxbridge.

3. Booking Process

3.1 The Customer may request a quotation or make a booking by telephone, email, online form, or any other method made available by Waste Collection Uxbridge from time to time.

3.2 When requesting a booking, the Customer must provide accurate and complete information, including but not limited to:

a. Full collection address and access details.

b. Type of property and any access restrictions, such as limited parking, narrow entrances, or upper floors.

C. Description, type, and approximate volume or weight of the waste to be collected.

d. Preferred date and time window for collection.

3.3 Waste Collection Uxbridge will provide an estimate or quotation based on the information supplied. The Customer acknowledges that the final price may differ if the actual waste volume, weight or nature of the waste at collection differs from that described at the time of booking.

3.4 A booking is only confirmed when Waste Collection Uxbridge has accepted it and provided confirmation to the Customer, which may be given verbally, by email, or by any other agreed method. Waste Collection Uxbridge reserves the right to reject any booking request at its discretion.

4. Customer Responsibilities

4.1 The Customer is responsible for ensuring that:

a. All information provided during the booking process is accurate and complete.

b. Safe and reasonable access is available for Waste Collection Uxbridge personnel and vehicles at the agreed collection time.

c. Waste is properly presented and is consistent with the description provided at the time of booking.

d. No prohibited or hazardous items are included in the waste unless explicitly agreed in writing and permitted under applicable regulations.

4.2 Where waste is to be collected from inside a property or from a location other than the kerbside, the Customer must ensure that the route is clear, safe, and free from obstruction. Waste Collection Uxbridge reserves the right to refuse service or apply additional charges if conditions on site are unsafe or significantly different from those described.

5. Payments and Charges

5.1 Charges for the services will be as quoted to the Customer at the time of booking, subject to adjustment where the actual waste or access conditions differ from those originally described.

5.2 Waste Collection Uxbridge may require payment in full or in part in advance of the service, or may agree to payment on completion, depending on the nature of the booking and the Customer profile.

5.3 Payment methods will be advised at the time of booking and may include card payment, bank transfer, or other methods accepted by Waste Collection Uxbridge from time to time.

5.4 If additional waste is presented on the day of collection, or if the waste is of a type or quantity different from that described at the time of booking, Waste Collection Uxbridge reserves the right to:

a. Adjust the price accordingly and request payment of any additional amount; or

b. Decline to collect some or all of the additional or differing waste.

5.5 All charges are exclusive of any applicable taxes, levies, or statutory fees unless expressly stated otherwise. Any such taxes or fees will be payable by the Customer in addition to the quoted charges.

5.6 Where payment is not received when due, Waste Collection Uxbridge may charge interest on outstanding amounts at a reasonable rate from the due date until payment is made in full, and may suspend or cancel any further services.

6. Cancellations, Rescheduling and Missed Collections

6.1 The Customer may cancel or reschedule a booking by giving notice to Waste Collection Uxbridge. The amount of notice required, and any applicable charges, will depend on the timing of the cancellation.

6.2 If the Customer cancels a booking with more than 24 hours notice before the agreed collection time, Waste Collection Uxbridge will normally cancel the booking without charge, except for any non-refundable costs already incurred.

6.3 If the Customer cancels with less than 24 hours notice, or fails to provide access for the collection at the agreed time, Waste Collection Uxbridge may charge a cancellation or call-out fee to cover costs incurred, including travel and staff time.

6.4 If Waste Collection Uxbridge is unable to carry out the collection due to circumstances beyond its reasonable control, such as severe weather, vehicle breakdown, accidents, road closures or safety concerns, it will notify the Customer as soon as reasonably practicable and arrange a new collection time. In such circumstances, Waste Collection Uxbridge will not be liable for any loss arising from the delay but will use reasonable efforts to minimise disruption.

7. Waste Types and Regulations

7.1 Waste Collection Uxbridge operates in accordance with applicable UK waste management legislation and regulations. The Customer must not present any waste for collection that is prohibited under applicable law or cannot be handled under the service description agreed at the time of booking.

7.2 Certain types of waste, including but not limited to asbestos, medical or clinical waste, chemicals, solvents, oils, pressurised containers, gas bottles, explosives, and other hazardous materials, are subject to strict controls and may not be accepted unless specifically agreed in writing and permitted under relevant licences and regulations.

7.3 If prohibited or hazardous waste is presented without prior agreement, Waste Collection Uxbridge may refuse to collect it, may terminate the booking, and may charge the Customer for any additional costs, disposal fees, or regulatory penalties incurred as a result.

7.4 The Customer confirms that they have lawful authority to dispose of the waste and that the waste does not include items that are stolen, unlawfully obtained, or subject to any third-party claim.

7.5 Waste Collection Uxbridge will transport and dispose of collected waste only to licensed facilities and in compliance with applicable duty of care and environmental regulations. The Customer acknowledges that once waste is collected and transferred, it may be sorted, recycled, reused, or otherwise processed in accordance with applicable regulations and best practice.

8. Access, Parking and Property Conditions

8.1 The Customer must ensure that suitable parking and access are available for Waste Collection Uxbridge vehicles and staff at the time of collection. Any parking charges, permits, or penalties arising due to a lack of suitable access, or due to inaccurate information provided by the Customer, may be charged to the Customer.

8.2 The Customer is responsible for obtaining any permissions or permits required for the services to be carried out at the property, including access to private roads, shared driveways, or communal areas.

8.3 Waste Collection Uxbridge will take reasonable care when carrying out the services at the Customer property. However, the Customer should take steps to protect any areas or items that could reasonably be at risk from the movement of waste or equipment.

9. Liability and Limitations

9.1 Nothing in these Terms and Conditions shall limit or exclude Waste Collection Uxbridge liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

9.2 Subject to clause 9.1, Waste Collection Uxbridge shall not be liable for:

a. Any indirect or consequential loss, including loss of profits, business interruption, or loss of opportunity.

b. Any loss arising from the Customer providing inaccurate, incomplete, or misleading information regarding the waste, access conditions, or property.

c. Any delay or failure to perform caused by circumstances beyond its reasonable control, including adverse weather, traffic conditions, accidents, regulatory changes, or events affecting third-party facilities.

9.3 Waste Collection Uxbridge total liability to the Customer for any loss or damage arising out of or in connection with a particular booking shall be limited to the total amount paid or payable by the Customer for that booking, except where otherwise required by law.

9.4 The Customer is responsible for ensuring that any items presented for collection are genuinely intended for disposal. Waste Collection Uxbridge will not be liable for any loss where items have been mistakenly included with the waste.

10. Complaints and Disputes

10.1 If the Customer has any concerns or complaints about the services provided, they should contact Waste Collection Uxbridge as soon as reasonably practicable, setting out the details of the issue.

10.2 Waste Collection Uxbridge will investigate any complaint in good faith and seek to resolve it promptly. The Customer must allow a reasonable opportunity for Waste Collection Uxbridge to inspect any alleged damage or service deficiency before any remedial action is taken by third parties.

10.3 In the event of a dispute, both parties agree to attempt to resolve the matter amicably before pursuing any formal legal remedies.

11. Data Protection and Privacy

11.1 Waste Collection Uxbridge will collect and process personal data provided by the Customer for the purposes of administering bookings, providing services, processing payments, and managing customer relationships.

11.2 Personal data will be handled in accordance with applicable UK data protection laws. The Customer agrees that their contact details may be used for service-related communications, including booking confirmations and updates.

12. Changes to Terms and Conditions

12.1 Waste Collection Uxbridge may update or amend these Terms and Conditions from time to time to reflect changes in law, best practice, or service offerings.

12.2 The version of the Terms and Conditions in force at the time of the booking will apply to that booking. Updated terms will apply to future bookings once published or made available to the Customer.

13. Governing Law and Jurisdiction

13.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.

13.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of services by Waste Collection Uxbridge.

14. General Provisions

14.1 If any provision of these Terms and Conditions is found by any court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall remain in full force and effect.

14.2 No failure or delay by Waste Collection Uxbridge in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy.

14.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of Waste Collection Uxbridge. Waste Collection Uxbridge may assign or transfer its rights and obligations to another entity in connection with a business transfer or reorganisation.

14.4 These Terms and Conditions, together with any booking confirmation and agreed service description, constitute the entire agreement between the parties in relation to the services and supersede any prior discussions, correspondence, or understandings.
